Résumé :

L’emprise de la connexion est reconnue par notre seul droit du travail français. Alors que les courriels et appels à caractère professionnel s’immiscent de plus en plus facilement dans la vie des salariés, le « droit à la déconnexion » est inscrit dans notre code du travail depuis la publication de la loi n° 2016-1088 du 8 août 2016. Ce nouveau droit, soumis à négociation, est entré en vigueur le 1er janvier 2017 dans le cadre de la loi travail. Nous cherchons à aller au-delà de ce que disent les textes, de leur ancrage dans une histoire juridique du fort portant le faible. Ce qui nous
intéresse, ici, c’est ce que l’informel fait au coeur d’une PME pour mettre en délibéré une déconnexion. Cette démarche, dans la mise en oeuvre d’une obligation légale au sein d’une PME, nous permet de poser un regard pragmatique à la fois expérientiel et analytique sur la réalité des entreprises vis-à-vis du droit à la déconnexion.

Abstract:

The grip of the connection is recognized by our only French Labor Law. While emails and calls of a professional nature are getting more and more easily into the lives of employees, the "right to disconnect" has been written into our labor code since the publication of the Law No. 2016-1088 of the 8 of August 2016. This new right, subject to negotiation, entered into force on the 1 of January 2017 under the Labor Law. We seek to go beyond what the texts say, their anchoring in a legal history of the strong bearing the weak. What interests us here is what the informal is doing at the heart of an SME to deliberate a disconnection. This approach, in the implementation of a legal obligation within an SME, allows us to put a pragmatic perspective both experiential and analytical on the reality of companies vis-à-vis the right to disconnect.
